Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Kinship iOS app, iMessage extension, or Chrome extension (collectively, "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a binding legal agreement between you and Grit Real Estate LLC ("Company", "we", "us", "our"), a limited liability company operating under the brand name Kinship.

2. Description of Service

Kinship is an AI-powered messaging assistant that generates draft messages and replies based on text you provide. The Service uses Anthropic's Claude AI to produce suggestions. These are drafts only — you are always responsible for reviewing, editing, and deciding whether to send any message generated by Kinship.

Kinship is available as:

• An iOS app with an integrated iMessage extension
• A Chrome browser extension for web-based email and messaging

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you confirm that you have your parent or guardian's permission. By using the Service, you represent that you meet these eligibility requirements.

4. Free Tier and Subscriptions

Free tier: All users receive 10 AI messages per calendar month at no charge. This count resets on the 1st of each month.

Pro subscriptions: Upgrading to Pro unlocks unlimited AI messages, all tone options, translation, and voice input. Pro plans are available as:

• Kinship Pro · iOS — $2.99/month, billed through Apple
• Kinship Pro · Bundle (iOS + Chrome) — $4.99/month, billed through Stripe

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. Prices may change with 30 days' notice to existing subscribers.

iOS billing: Managed by Apple through your Apple ID. You can cancel at any time in Settings → [Your Name] → Subscriptions on your iPhone.

Chrome / Bundle billing: Managed by Stripe. You can cancel by contacting support@kinshipapps.com.

5. Refund Policy

We offer a 14-day refund for new Pro subscribers who are unsatisfied with the Service.

• iOS: Refunds are processed through Apple at reportaproblem.apple.com. Apple's refund policies apply.
• Chrome / Bundle: Email support@kinshipapps.com within 14 days of your initial charge and we will process your refund within 2 business days.

Refunds are not available for partial billing periods or after the 14-day window, except where required by applicable law.

6. Acceptable Use

You agree not to use the Service to:

• Generate messages intended to harass, threaten, defraud, or harm any person
• Produce spam, phishing messages, or unsolicited bulk communications
• Impersonate any person or entity in a misleading or deceptive way
• Violate any applicable law, including privacy laws and anti-spam regulations
• Attempt to reverse engineer, scrape, or extract data from the Service
• Circumvent usage limits or access controls through automation or other means

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

7. AI-Generated Content

Messages generated by Kinship are AI suggestions and may be inaccurate, incomplete, or inappropriate for your situation. You are solely responsible for reviewing any AI-generated content before sending it. We make no guarantee that AI-generated drafts will achieve any particular outcome in your communications.

Do not rely on Kinship for legal, medical, financial, or emergency communications.

8. Intellectual Property

The Kinship name, logo, and all related software are owned by Grit Real Estate LLC. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes in accordance with these Terms.

Message drafts generated for you by the Service may be used freely by you. We claim no ownership over the content of your generated messages.

9. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our data practices.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or appropriate.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GRIT REAL ESTATE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $10 USD.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via in-app notification or email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Sections 7, 10, 11, and 14 of these Terms survive termination.

14. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Texas, and you consent to personal jurisdiction in that forum.
